Ministry of Digital Development, Communications and Mass Media developed a draft resolution on self-registration of citizens in UBS

A draft government decree developed by the Ministry of Digital Development on approving the procedure for individuals to place their biometric personal data (PD) in the unified biometric system (UBS), as well as the conditions and terms of use of these biometric PD, has been published for public discussion.

This document was designed in pursuance of Part 1.3 of Article 14.1 of the Federal Law of July 27, 2006 No. 149-FZ “On Information, Information Technologies and Information Protection”, which provides for the possibility of self-registration of individuals in the UBS.

This norm was introduced by law No. 441-FZ dated December 30, 2021 due to the need to establish the totally remote interaction between parties to various relations. It must be ensured through reliable and legally approved remote identification of the participants of the interaction.

The Ministry of Digital Development notes that such identification is currently provided by the Unified Identification and Authentication System (UIAS) and UBS.

As stated in the explanatory note, in order to maximize the number of subjects who can receive services remotely, it is necessary to accelerate the collection of biometric PD and their placement in the UBS, including by means of individuals’ self-registration of their biometric PD in this system.

The draft resolution establishes the right of individuals to place their biometric data in the UBS using a mobile device via the “Biometrics” mobile application. 

At the same time, such placement is allowed if you have a verified account in the UIAS, as well as if you have a valid international passport with biometric data. The Ministry of Digital Development believes that these specified conditions are to secure biometric data. 

The draft resolution also describes the cases in which biometric PD placed in the UBS independently by individuals may be used, and also sets a total period for their use — three years. After three years from data being placed in UBS, it will no longer be valid, and in order to receive services, it will be necessary to place the data once again.

It is necessary to recall that in September 2021, the Ministry of Digital Development already released for public discussion a draft government decree concerning an experiment on self-registration of citizens in a unified biometric system (UBS) using personal computer or a mobile device. The experiment was planned to be carried out from October 1, 2021 to October 1, 2022. The decree has not yet been approved.

It is also valid to note that, according to the Rostelecom representative, right now 40-45 million citizens of the Russian Federation have already submitted their biometric PD; this number includes not only those who have registered with the UBS, but also those who have registered with other PD operators. 

It is proposed to define the following cases when it is possible to use self-hosted biometric personal data: 

• intermediate attestation on educational programs of higher education — bachelor's programs, specialist's programs, master's programs;

• transactions using payment cards in trade or service organizations in an amount not exceeding 1,000 rubles, including value added tax;

• remote customer service for banks that, in accordance with Federal Law No. 115-FZ dated 07.08.2001 “On counteracting the legalization (laundering) of income acquired from crime and the financing of terrorism”, place information in a unified biometric system; as well as professional participants in the securities market, insurance organizations, non-state pension funds, microfinance companies, previously identified by this financial institution in accordance with the requirements of the legislation of the Russian Federation, in cases that do not contradict the requirements of the legislation of the Russian Federation, including Bank of Russia regulations;

• authentication of a client by the bank — a client being an individual when servicing him in person in cases that do not contradict the requirements of the legislation of the Russian Federation, including regulations of the Bank of Russia;

• payment for travel on the infrastructure of the Moscow Metro and the Moscow Central Circle;

• access to the territory of state bodies and organizations through the system of control and management of access to the territory of these bodies and organizations, with the exception of organizations of the military-industrial, nuclear energy, nuclear, weapons, chemical, fuel and energy complexes, organizations related to transport infrastructure facilities , subjects of critical information infrastructure, facilities, the commission of a terrorist act on the territory of which can lead to emergencies with dangerous socio-economic consequences according to the categorization carried out in accordance with the Rules for the development of requirements for anti-terrorist protection of objects (territories) and the safety data sheet of objects (territories) , approved by Decree of the Government of the Russian Federation of December 25, 2013 No. 1244 "On anti-terrorist protection of facilities (territories)", regime facilities in accordance with the Decree of the President of the Russian Federation of November 30, 1995 No. 1203 "On approval of the list of information classified as state secrets", preschool educational organizations and general educational organizations;

• conclusion of contracts for the provision of communication services via the Internet;

• ensuring the issuance of a personalized card for visiting sports competitions;

• authentication on a unified system of state and municipal services.
